I was wondering if anyone knows the rules on this.

I finished working for an employer a few months back.


Yet, I'm still receiving checks in the mail.

Can I deposit them, or once they find out the mistake will I have to pay them back?

I was employed by the state.

Yes, if you cash the checks they can require you to pay the money back. I'd suggest that you contact the employer ASAP. Among other things, if you don't get the situation resolved, you're going to be paying taxes on more money than your earned come tax season.

How many weeks did they hold when you wher hired? Some companys hold up to the first 3 weeks pay.Which means you will receive 3 weeks pay after you quit.

Since the last day worked was a few months ago, it seems odd that you'd still be receiving a pay check. In addition to what's already been offered, did your separation include a severance package. Sometimes these are paid over a number of pay periods instead of a lump sum.

I agree with Marketeer. If you have a reason to believe that you are receiving these monies in error, I'd strongly suggest that you contact your former employer to discuss. In addition to the tax implications, your former employer may require repayment in full. It's better to nip it in the bud instead of letting it grow into something unmanageble.

BTW, Joe, it is illegal in most states to "hold back" pay. If I knew what state the poster was in, I could advise as to the law in that state.

Pattymd is correct! Often employees assume pay is being held; but in fact they are being paid on arrears.
