I am supposed to be moving into a home on Sept. 15th and just found out this weekend that the current tenants are refusing to move out until Oct. 1st b/c the house they are moving to is not finished yet (which means if something goes wrong it could take even longer!)

Because I currently live in an apt. I had to give them a 60 day notice to break my lease and now they have rented out my apt. so I have to be out by Sept. 15th no matter what and I have no where to go. To make matters worse I teach art and music out of my home so not only do I not have a place to live but I may have to close down for a few weeks until I can move in to the house.

My new landlord is furious with the people as they are on a month-to-month lease and have been telling him for four months now that they were going to move and they keep changing the dates. What legal rights does he have and what rights do I have? Should the new landlord pay for a place for me to stay while I wait for these people to leave? Can I get my deposit back b/c the place I was promised is not ready? Can I stay in my apt. longer even though somebody else is supposed to move in as long as I pay?

I am so confused, upset, and angry at this situation. Any and all advice would be greatly appreciated!

No, you can not go after the landlord, he has to abide by the law in evicting them. He should however, since they are month to month tenants, tell them he is not renewing thier monthly lease. It will still take a while to get them out if they refuse to leave. A notice has to be sent, and they have to have thier day in court. So sorry this happened. If you got your deposit back, can you rent elsewhere immediately? Did you sign a contract with the landlord stating when you could move in? If you did, his problems are irrelivant, and he may be liable, other than just the deposit. Someone else with alot more experience in this type of matter will be around, be patient.
