Hello everyone I've got a quick question.

I doubt this is discrimination but seemed the best place to post.

Where I live in Alabama there was a law passed saying there is no smoking allowed in any public building with circulating air. So no more smoking in our building because of visitors. This is an industrial plant by the way. Half of the building has a/c so of course there is no smoking in there anymore. But the company decided to ban all smoking from the building and moved the 15 smokers outside. The only problem there is, is that there is no weather protection. Completely in the sun/rain/heat/cold. Is there any law that protects against that?

I really do understand the no smoking inside but just wish there was something I could do to get us a canapy of sorts other than find a new job.

No there is no requirement that your employer provide shelter for smokers.

And to add to what ElleMD has offered, "smokers" are not a protected class with respect to Title VII of the 1964 Civil Rights Act (http://www.eeoc.gov/abouteeo/overview_practices.html). So this would not be considered unlawful discrimination.

If you're being allowed smoke breaks, you're already getting more than the law requires.
