View Full Version : Getting My Security Deposit Back!! New Jersey

Here's the situation. I move out of my apartment on June 30, 2006. I told him on June 15 but he said that I was supposed to give 30 days notice before I moved out but it was okay with him. We got into many talks about getting the security deposit back but he said we would have to do a walk-through to decide how much I would get back. He came up one day and we did a quick walk-through and he said that it looked like it only needed for the walls to be cleaned. I thought the walls were clean but I spent 2 weeks scrubbing the walls and floors anyway. I offered to do whatever repairs he wanted me to do before I left. He never requested any work to be done. He said he was going to use a shampooer on the rug in the living room and replace the tile and carpet in the bed room for the next tenant. When I left the apartment, he said it looked good over the phone and we did not have to do a walk through and that he wanted to look at the lease to see how much my security deposit was. The paint, carpet, hardwood floors and bathroom tile were in bad shape to begin with. Now 1 1/2 later when I am asking for it back, he leaves a voice mail saying he was ignoring my phone calls and that we left him a "$hit house" and it smells like cat unrine. I did not notice an odor when I left. In the voice mail he said everyone in the apartment building (3 people) documented to shape of the apartment. I do not think that will make any difference because there was nothing saying what the shape was before we moved in. He is now claiming threathening to sue me for $2500 for repairs, if I try to pursue this any further. I think he is just trying to scare me and get me to pay already needed repairs. Any advice would help out a lot. I just want to know if I have a solid case or not. Thanks.
