Me and my gf are both 16, she has some many problems with her biopolar mom and her grandma and grandad, Can she legaly come live with me if my mom agrees to take her in, and she not be dragged back home by the cops when someone files a report like her mom or family member, you wants her to come back to live with them, if she doesnt wanna be there. And if they can come take her back they what other options does she have before a court!

Girlfriend is a minor. Of course, she can be taken back home. Whether or not your mom agrees to this plan makes no difference, because she is not Girlfriend’s mom. When Girlfriend is 18 she can live wherever she wants.

NC does allow a minor who is at least 16 to petition for emancipation. She would have to prove that she is capable of fully supporting herself--paying for rent, utilities, food, medical expenses, etc--which does not mean depending on someone else for even partial support. She would also have to provide a valid reason that emancipation would be in her best interest. Not getting along with her parents is not a valid reason. Mom being bipolar is beside the point unless it is in some way affecting her parenting skills…which has to be proven. Even then, the judge may still deny emancipation and simply order Mom to seek treatment, attend parenting classes, etc.

Minor emancipation in NC (and actually in all states) is RARE. I’ve known of cases in NC (where I also live) where the parents were even in support of emancipation and still it was denied.
