This is a terrible situation! I opened my heart and home to a woman in need 5 years ago. We never discussed any payment arrangements, she just pays me $100 a week and occupies one room and storage for alot of her stuff around the house and garage. There is no contract oral or written. She is pretty good about paying on time, only failing to pay 2 times. The problem is that she is very nosy. She is constantly in my business, reads my mail and that of my adult son, who is also living here. She has made a nuisence of herself and I want her to move out and find her own place. We have always referred to the situation as room mates, although she pays a tiny fraction of the expenses here. My mortage alone is $1650 a month. The electric is sky high. She has alot of money in the bank from saving what she does not pay around here! At this point even if she did pay more, she simply has worn out her welcome. In the winter she insists on keeping her windows open because she is too hot, while my electric bill goes sky high! Anyway, I need to know is she considered to be a tenant since I own this home and occupy it or is she a room mate. Again there are no records of any kind, she pays cash and there has never been a lease or rental agreement oral or written. Do I have to give her notice to move and how much- I dont want to be unkind and would like to give her 2 weeks, since she pays weekly. But her constantly getting into my personal and financial information is unnerving and wrong. I trusted her 150% when she moved in. I just got my home out of foreclosure and it is on the market. She thinks when the house sells we will get a place together. I have changed my mind. SHe is so jealous of my son and is undermining anything he accomplishes. I know I should have gotten things in writing - Famous last word I guess and I was trying to help a friend who was down and out. Now I just want her out! thanks for any advice you have! :confused:

Isn't there anyone out there who knows the law in Colorado on this issue! Things are getting worse- she digs into my banking info and I am getting more and more afraid of her malicious intent! Since I am the homeowner and she is living here sharing some of the expenses as a roommate, how much notice can I give her - can I just ask her to leave ? she gives me money weekly, not monthly. would 2 weeks notice be legal? would I still be considered a landlord? I doubt she would go to court over it, but I at least want to do what is right, while getting her out of here ASAP and protecting my privacy...I have not let on that I know about what she is doing yet- thanks for helping! :eek:

It is a federal offense to open someone elses mail, so if she had to actually open the envelope, this should be reported. You could by all rights, give her a notice of a rent increase, like say 700 per month utilities included, I don't think she would be wanting to pay this. It would have to be a 30 day notice on that.

I plan to give serve her with a written 30 day notice, and will let her know very briefly why. My son will be there as a witness. I will let you know how it goes- thanks very much!

I told her that I appreciate the good things about her and have some real concerns about some things she has been doing in my home, Invasion of privacy, reading the mail, defamation of charactor by going to the neighbors and disclosing what she found in the mail, etc. I told her those actions were criminal and unacceptable and I would have to draw the line. I asked that she agree to voluntarily leave and find her own place as soon as possible. She found an apartment that same day, started moving within 2 days and has nearly finished moving. I and the other neighbor helped he move yesterday quite a bit since we dont want this to be drawn out and would like to have as little annimosity as possible. I will change the locks when she has removed the last of her belongings tomorrow and be very relieved. thanks very much for your help! If she would not have agreed to move voluntarily I would have gone to giving notice and possible eviction. I am glad it did not have to come to that. Happy ending for all I think! thanks!
