View Full Version : Alleged Mold in Rental Unit Connecticut

I own a condo in Fairfield County CT. I rented it to my original tenant, for a one year period; who "broke the lease early" because he was buying a new home. He found someone to sublet the remaining 3 months. My original agreement is still with the original tenant and I am still in possession of the original security deposit. The original tenant drafted a sublet agreement between him and the the subletor. My issue is the subletor has only been in my rental unit for two weeks and the following chain of events have occured. Just after being there a couple of days the subletor called to say there was a leak with the kitchen sink. I called the plumber and had it repaired. About a week later he calls and says the masterbedroom toilet doesnot flush properly. The subletor at this time also mentions that he wants the dryer vent replaced because its putting moisture back out into the air. (In these condo units the washer/dryer units are in the middle and approx 20ft from an outside wall, so they have those inside dryer caps on them. These condos were build in the early 70's. ) After the plumber was out to consult on the toilet issue the subletor says toilet needs to be replaced and that the plumber said the dryer vent is out of cold and is a health hazard. I call the plumber to get the facts, yes the toilet needs to be replaced, I authorized the replacement. They say that they do not deal in dryer issues. This was on a Friday afternoon. By Monday morning the subletor called to say they had to take his child to the doctor because he had a asthmatic episode. He said the doctor told them that the child has mold in his lungs from the dryer unit. The child has never had any asthmatic issues prior to being in this rental unit. The subletor had the doctor write a note. The note suggested that the dryer should be repaired as to not induce any more asthmatic effects. I called the doctors office to clarify the letter. They said the dryer is not the cause of the mold but it doesnt help in clearing up his lungs. I also asked if a culture was done on the child to prove that it was mold and was told no they did not do any cultures. The subletor now wants the following: 1)to move out immediately 2) the return of all this months rent 3) $500 for moving expenses 4) $200 for lost wages, hassle, and cost of the nebulizer. What course of action should I take, What are my rights and ....basically what do I do? Thank you for any assistance.
