My roomate moved out at the end of May.....
No warning, Nothing....
Next thing I know, she wants me to hold on to her stuff....
reluctantly I agree because I figure if she takes her stuff I will never see the money that she owes me....
she owes me well over $1500....
That is alot of money for me....
as I am raising my one year old daughter on my own...
Can anyone tell me how long she has before her stuff becomes leagally mine and I can sell it for the money she owes me?? :confused:

Unless she signed a specific contract saying you could sell her things to pay for back rent, I wouldn't even go there. You cannot withhold her property to force her into paying the debt she owes you. She would have the right to sue you for the value of her belongings (or demand they be returned, if you still had them). What you need to do is file a suit in small claims court for the money that she owes you. Bring her things with you to court if you feel she will use your withholding them as leverage and offer to return them. Once there is a judgement against her you will have a much easier time getting your money.

The rent owned, and the property are two different subjects. You could send her two certified letters, one stating that she has 30 days to pay rent or you will sue, and another stating the storage fees for holding her items. Then in court you could also recieve money for holding these things, but make sure that nothing happens to these items, because she could sue you for the value of those items. Good luck to you!

she still has the keys....
she could get her stuff when ever she wants...
meanwhile my land lord charges us for haveing 3 ppl living there b/c her crap is still there...
I just want it out of my house....
I figured I could make my money back rather then just put it all out in the yard....

You could always change the locks and charge her for doing so, since she has failed to return the keys, and could retaliate against you for anything. I may be wrong, but I really think you could do this legally!

so this is what I did...
I put all her **** on the porch, landlord said it was ok....
and I changed the locks....
whatever happens to her **** happens...
not my problem....

Should put you in the clear then, since you are technically not withholding her property. And you're right, what happens to it now it not your problem.
