View Full Version : I love my job...but (on-call) California

I do, I love my job.
I work 12 hour days M-F, and I'm on-call S-S ...well...that's the thing, I'm never really off the job.

I am expected to be watching systems all the time I hvae the emergency phone "on" me, wich means that customers can either leave a message of press one to be connected.

Now, to me, on call means when my phone rings.

My boss, however thinks I should be watching the systems all the time while on-call and following up on open issues.

I am compensated M-F by my hourly pay, after I leave the office, when I am "on call" I will occasionaly get calls from my boss asking about failure in this or error in that as he has the systems running on his PC at home and to his blackberry.

I have a company cell phone and connect to the office via VPN with a company lap top.

Now my question is, if he expects me to be watching systems, am I on call, or on duty?

This makes it improbable for me to play in the yard with my kids, to take a bike ride, take a long hot shower or even go to the movies on weekends when I am "on call"

Am I on-call or on the job?

It is a small company with 4 technical employees and about 8 additional staff.

Are you paid for your time when you are actually answering the phone or connecting to the company's system? That time, at the very least, is compensable. If you are expected to be physically at a computer at all times, that would be compensable as well. I think realistically your boss just expects you to check in at regular intervals, and the checking time would be compensable.

Are you exempt or non-exempt? It makes a difference.

He says he is paid hourly, so I assumed non-exempt. Joe, are you paid more than $47.81 an hour?

LMAO...If I was paid HALF of that I'd NOT be complaining...they could call me in the mortuary for that!

For some reason, very few companies use that exemption to the overtime laws :D
