Hello,

my employer and I came to a settlement agreement in mediation a couple weeks ago. At the end of the mediation, there was a quickly handwritten agreement that stated that there wouldn't be any disparaging remarks made about the the other party and that the events of mediation be kept confidential.

When I went back to work, I have turned in my resignation and have been bombarded by hundreds of questions. I haven't told anyone at work though what happened.

However I have another friend who doesn't work at the same location that I shared probably too much with as she was kind of a confidante through the whole very stressful process.

Now I wished I hadn't told her. Is there anything I can do at this point, or do I just have to hope she won't tell anyone?

I guess they are going to do a more formal typed up agreement and have us sign, but not sure if they are going to date it the date of mediation...

I'd consult legal counsel. You violated a written agreement, which is never good. Whether it was an enforceable contract or not is a matter best left to a lawyer.

Alhough you technically violated the terms of what is likely an addendum to the settlement agreement, I do not think you have much, if anything, to be concerned about.

Unless your friend broadcasts whatever information she learned to many others, which eventually gets back to someone in the know at the employer, then it will likely never become actionable. Yet, even if the aforementioned occurred, then the employer would likely have to demonstrate that it suffered some damages as a result of your disclosure before it would invalidate the settlement agreement.

Having said that, it is never a bad idea to consult counsel as suggested by Elle.
