View Full Version : Fired by a fax machine!

Last week our regional manager and her asst. conducted an audit of our store which is normal about once a month. 2 of us run the store, me a (CSR) Customer Service Rep. and a manager. We were found to have not complied with some company policies which were small mistakes and very correctable. After the audit was finished the regional manager and asst. took my Manager outside and explained the audit to her. I was not allowed to be present. When my manager was notified of these mistakes she had told them that we were working to correct the mistakes and she left it at that. It seemed all was fine when they left. The next day I came into work as usual and opened the store. My manager arrived at 10am. The phone rang shortly after she came in. The regional managers asst. was on the phone and she said she was faxing some papers over for my manager to view. She said that she would call back when we got them. After about 5 mins the fax came through and the phone rang, it was the asst. again. She told my manager that she wanted her to not hang up the phone, but to set it on the counter and read the fax and when she was finished she was instructed to hand it to me. It was a written termination letter for me. I was never warned verbally or written that anything was wrong with my job performance. On this faxed termination letter there were several false and misleading accusations that to this day I have no idea what they even are. I was not allowed to defend myself on any of the charges and the letter stated that I was to surrender my keys and leave the premises at once and not return. Can you be fired by a fax and not ever told what you actually did to be fired? these gutless people never even told my manager they were firing me, nor did they give her any reasons for my termination. They never even suggested that they were going to fire me..Iam still in shock.

It is a rotten way to handle it but no law prohibits them from terminating you via fax, phone, smoke signal or singing telegram if they so choose.

Nor is there any legal requirement that the reason for termination be accurate. You can certainly try to meet with them to correct the inaccuracies but they are not obligated to change their minds.

As much as it is unfair, it is perfectly legal. Sorry to tell you that, but they can fire you any which way that they choose. It may not mean that you won't qualify for unemployment, but isn't illegal. Sorry..... File for unemployment, as that is your only option.

Sorry, I agree with the others. It's a poor way to handle things (did this person attend the Ebeneezer Scrooge School of Management?), not the way I would have handled this or would want to be involved in, but I don't see where they have broken any employment laws based on what you reported.
