My friend rents an apartment with a troublesome upstairs neighbor.

The neighbor received an intent to quit notice from the landlord on July 15th.

The neighbor was supposed to move out on August 15th, but is now causing a stink because he thinks he should be able to stay until the end of the month because he already paid last month's rent when he signed the lease.

Does anyone know anything about this? Does the landlord have to give him half of his last month's rent back upon moving out? Does teh neighbor forfeit the last month's rent?

Any info would be greatly appreciated

OK, let me add some info to this:

The kid upstairs has had 10 police complaints against him at this address according to the police department. Three of those were reported by the downstairs neighbor.

He gave the Notice to Quit notice on July 15th. Is the kid legally due out by the 31st since the rental period would have begun on August 1st?

I read that the notice to quit gives the evictee 30 days upon the beginning of the next rental period, so if the rental period begins on the 1st, then the 30 days would be up ont he 31st?

I am finding some conflicting info online and if anyone out there is landlord/tenant law savvy and has any info on this topic,I woudl really appreciate it.
