How much notice is a tenat entitled to in a lease renewal?

Is it none or is it 90 days, ect?

We have been renting the same house since 2001, after the first year the landlord did away with the real estate company and wanted to payments sent directly to him. We got this notice from the real estate agent, not him.

The enxt year we were on give 12 days to renew the lease or move or it would automatically renew. The only thing the new renewal state is the cost, time frame, and all previuos lease agreements imply, BUT we never got another one from him, and it had been 2 years since the one with the real eastate company. Those 2 years I did try to get him to let us go monthly w/90 day notice b/c we've wanted to buy a house.

Here we sit 3 years later dealing with the same stuff. We didnt get our renewal notice until the begining of June only giving us less than 60 days to renew or find a place.

Then I get told 2 weeks later to not send rent or anything to him after the next week b/c they were leaving and they would call when they came back. I have no contact numbers in case of a property emergancy either. nor even any notice when they would be back

Well We signed it b/c he wanted it before he left(and now there is another name on the lease that wasnt on the orginal, on his end).

So heres where our problem comes in, We got offered a great deal on buying a house. I have no way to talk to him about it, we need to know what to so, and I am wondering if our lease is even legal? I have a meeting with my Lawyer next Tues

Usually the tenant and the landlord are both aware of the term (length) of the lease. Was the lease you signed a 12 month lease agreement? If so, then you can reasonably assume that the lease period will end after 12 months and you'll either need to renew your lease or give the landlord notice (30 days usually) that you're not renewing. I'm confused as to how you can not know when your lease ends... it should say so right on the lease.

Honestly, if the lease term isn't listed on there, he really can't do much in court should you decide to move in 30 days. Unless it specifically states the terms, 12 mo lease, 60 day notice for moving, etc., I can't see the contract standing up in court. I would start looking for a place, and give 30-60 days notice when you find something. That is ample notice. But again, look over your lease very, very carefully before you do anything.

I know our lease ends on the 31th, what I was asking is there any time frame, besides a a couple of weeks he needs to give us in order to renew it?

The new "lease" stated a 12 month period but how much legal time do I have to sign it and send it back?

Its not my job to call him for a lease renewal, he's suppose to be top of that.

All I am looking for is if he broke the lease in away by any of these:
-not giving us enough time to renew
-by leaving for 2 months so far, with no contact #
-by adding another name to who the lease is with, but saying all the previous lease requirements stay in effect, even though the other landlord was not on that contract

Honestly, If I were you, I would contact a real estate attorney to look over it. It may cost you all of $50.00 to have someone tell you for sure, by law, and without a doubt. Without seeing the acutal lease, we really can't help you. It is all dependent upon what the lease says. Good luck!!

There is 'NO” time time in PA where the state demands that the lease be renewed. In fact the state does not address the issue at all. In PA your lease contract period of renewed is governed by your lease. The same applies for the time period you are required to vacate. If you have no lease, then a 5 day notice is required. It is also very common for landlords to have you sign a “waiver of notice” meaning that if you are in default in your lease, the landlord can head directly to court and file for eviction.

If there is nothing in your lease regarding renewals, and you signed a new lease, then you would be bound by the terms of the lease. Even if the LL did not offer you a renewal in a timely fashion it is not a big deal. your best option is to offer a couple of months rent to back out of the contract and get a written release from your lease contract.

regarding your other questions of being two months without a contract, all it meant was that during that period, you were a month to month tenant and could have given your 30 day notice.

The fact that there are two owners or managers on the lease is not relevent. They are agents and both equally responsible.
