View Full Version : Just pay cut for exempt employee? California

I worked for my current company for about 4 years. 2 years ago i got promoted and put in charge of our warehouse and 15+ employers. I was also put on a salary. Now I was told that i will be receiving a pay cut of about $275 less a week. I looked under U.S. Department of Labor laws exemptions on this web page http://www.dol.gov/esa/regs/compliance/whd/fairpay/fs17a_overview.htm

From what I understand I fall under the Executive Exemption. Is it legal for them to cut my pay? They are not giving me a valid reasoning behind it and force me to do duties that do not fall under my job description.

As long as you have received notice of the decrease before it occurs, and your guaranteed weekly salary does not fall below the California minimum for exempt status, yes, it is legal. How much will your new salary be per week?

from $775 to $500

$500/week is below the minimum salary guarantee for exempt status in California. Accordingly, at that time, and assuming you are not performing a job where the weekly salary guarantee does not apply, you will become a nonexempt employee and eligible for overtime pay.
