Can anyone tell me if I am entitled to my 100 hours comp time after giving my two weeks notice and my one weeks vacation time? :confused: I am leaving because my boss hit me in the back of head and has made my work environment hostile!
I work for a City government and they have all stopped talking to me.
Any help would be appreciated.

There is no union. We were suppose to be protected by Civil Service...but, that is only if you remain an employee.

My job gives us p.t.o or paid time off, and it accrues every paycheck. When we quit, we do get reimbursed for it in our final check, but every place differs. What does it say in your contract or the policy book, if you didn't have a contract. Did you press charges for the assault? Did you get unemployment, or are you not even done with your final 2 weeks yet? I would contact your states Department of Labor, to see if there is anything else you can do. If you want, can you tell us a little more about this bop on the head?

In Mississippi, there is no statute on PTO payouts at termination. This would be a matter of company policy.
Most likely since you work(ed) for local government, I'd be very surprised if their PTO policies were not clearly outlined in a policy manual or employee handbook. I'd reference those materials or inquire internally for clarification of the policy.

And, assuming you were a nonexempt employee, the law requires you be paid your comp time at termination. Readers of this thread, please note that this applies ONLY to governments and qualified agencies of governments; comp time in lieu of overtime is NOT allowed for private employers.

Thank you all for responding.
To give a little more information...I was cuffed on the back of the head/neck hard enough to bring me from sitting up to almost hitting my head on a keyboard. I was hit from behind and she was joking around (I guess). Anyways, I applied under Workman's Comp for the time I was off....they have not approved it yet. If it wasn't bad enough having a headache 24/7 she said she couldn't of caused the injury she would have had to stomp on my neck...so, she became obnoxious. I had a week off. I am back at work, I gave my notice before I came back. I can't risk being hit again, jokingly or not. I had cancer surgery on my throat (thyroid) less than 6 months ago and do not need any further injury or insult. I am a single mother and need my comp time paid...I will be without insurance and money on 8/18/06.
Anyways, when I hired on with the City they did not give me a handbook. I have been previously told that they do not pay out comp time or sick time when you leave. I have about 100 hours or more of comp time and worked the hours...I just want to be paid for them.

Is there a place where I can print something showing that they need to pay me my comp time?
