View Full Version : Unpaid holiday and vacation Florida

Before I had my baby, I had told my supervisor that I would be taking a month off and come back after that time. My son was born on April 23 and on the 25 I went to my job and told my manager that I'll be back the following week. However, that Monday was a holiday "Memorial Day," so I went back on Tuesday. The week after I went back to work when I received my check, I did not get paid for the holiday and when I asked the HR, which was the owner's daughter, she said that she was going to try to convince her Dad :confused: "the owner" because she knows I was on leave of absence. I never got paid for that day. Does this sound right?
Another question......I gave my employer a two-week notice. My company issues vacation checks on July 7. My last day of work was June 23. Should I have received my check since I gave a two week notice? Didn't I earn and deserve that money since I had worked for them for over a year??? :(

It is strictly up to the employer whether or not to pay holiday pay; there is no law that is going to force them to. In most companies, employees on a leave of absence do not get paid holiday pay.

It appears that your company has a practice of cashing out vacation annually. Am I understanding this right? Even so, there is no law in Florida that requires the employer to even provide vacation, let alone pay accrued vacation at termination or pay you during the normal payout period. Honestly, if you were terminated at the time the vacation cash-out was paid, I'm not surprised that you were not paid for it. It's very likely the policy/practice is not to cash out vacation for individuals who are no longer employed, notice or not.

Sorry, there are just no violations of any law here.

I was confused about it because I was told by a few friends that I should get my vacation pay because I had earned it. I should have stayed with them for a couple more weeks, huh! :D I couldn't, the reason why I left was because I moved back to Kansas and my lease was up at the end of June. Florida is just way too expensive, but anyway. Thank you for answering my questions. I really appreciate it!
