I work at a salon/day spa in Texas. Most of us are 50/50 commission, so we only get paid when we do a service (haircut, facial, massage). We have been told by the owner that we have daily "duties" that we have to do, like sweeping, dusting, laundry, washing dishes and other duties. We were told that we get two 15 minute breaks and an hour for lunch and that we cannot be sitting around doing nothing. Both the hourly and commission employees are required to do these duties. My question is this, can she make those of us who are commission, do these "duties" without paying us? There have been days when I have nothing scheduled, which I made no money, but have had to clean her place of business. Is this legal?
