I work in Florida, 1 week ago I gave my employer my 2 week notice. I told him I was going into a sales position and figured he would just ask me to leave. However, he ask me to work out my 2 week notice. The other day I asked HR if he was going to pay me for unused vacation time since I was giving a notice and when I was going to receive my expense check for travel from the previous week. The manager sent me a email telling me that it was not the companies policy to pay unused vacation time and that he would get the expense check to me this Friday. I really don't see the reason for going back since he is not giving me any compensation for working out a notice, what's the point? However, I am fearful that he may not pay me for the expenses from the travel. I've worked there for 2 years and have never seen a policy book and when asked they were always working on it. Do I have any recourse on the unused vacation time? Can he hold or refuse to give me the expense check? Should I go back to work until I receive this check? Thanks...

Neither Federal nor Florida law requires that you be paid for unused vacation time or for expenses.

If you work out the notice time you have to be paid for the time you actually work. You do not have to be paid for any time you do not work.

Even if the travel expenses were business realated? They sent me to do a sales presentation, the only thing that they paid for up front was the airfare. I paid for accomodations, transportation and entertainment. How could they not pay me for a business trip?

Because the law doesn't say they have to. If you don't get reimbursed, I think you can claim it on your income tax. But you said they said you'd be reimbursed for the expenses, what makes you think they're lying to you?

Not getting paid for the vacation, after giving a 2 weeks notice, just took me off guard. I've spoken to previous employees who were compensated and never heard of any such policy. So, I am a little leary about him paying me the expense check. We'll see when I go in tomorrow. Thank you for your time.
