the father of my child keeps changing his tune one minute he is saying that he is going to try and sign away his rights to our son the next he says he is going to fight for visitation/custody. if he goes to court and trys to sign away his rights and they tell him no and he then trys for the visitation will he get it when the court already knows about him wanting to sign away his rights?

First, he cannot just sign away his obligations. If you are married (not with a boyfriend), your husband may adopt the child. In that case, the fatherhood of the child is tranferred, and the bio dad will no longer be obliged.

A child legally MUST have a father.

There is a very good chance (based on the very limited information here) that he will be granted visitation if he wishes it. CS will also have to be worked out at that time... nobody rides for free.
