Hi all, Hoping somebody can please help :)


My sister had a child 4 yrs ago and she gave the child her ex husbands last name.

But the child is actually her current husband last name

They want to change his last name
The ex is not contesting it

Can somebody please tell me what would be the first step
They are in Petersburg VA
What forms would they use, and WHAT DO THEY NEED IN ORDER TO DO THIS
And where exactly do they have to go to do this.

Any help is needed and appreciated please

Sorry, I'm confused. Is the father of the child the ex or the current husband?

The father of the child is the current husband.
When she had the child she was with the exhusband..and she gave him his last name

But its actually her current husband child

They want to change the child name to his

Nope the current father is the legal father
The ex husband is not trying to fight it he knows its not his son
The only thing is they want to change the last name to the legal father last name

If paternity has already been established, either with a DNA test or the biological father signing the aknowledgement of paternity forms, all they need to do is go to the Juvenile court in their area and file some papers to change the child's name. As long as the mother and father both agree to the change, the court will also agree.
