Short story as much as I can;
We are in Alabama, the ex-wife is in Florida. Son is 14 soon be 15 in Nov. Divorce in 98 in Alabama. Ex has custody. Son did not want to move to Florida summer of 2004? (I think, sorry I have memory probs) Anyway He told us he didnt want to go and told his mom so too. We did not know about the Alabama Parent-Child Relationship Protection Act at that time. She didnt give any notice either (unless you count 2 weeks and we learned from the kids) Hubby asked her not to take them that far away and she claimed she had a job waiting on her which was a lie. He even asked to let the son move in as he really didnt want to go when. The son cired and begged mom. The children dont come up here alot and she never has called to give us a phone # or address of where they are located either. We do have a phone # (caller ID) of course she has called for extra money! The son has told us again he wants to move in. Is there anything we can do now about her moving not only more then 60 miles but completely out of state, plus he is 14 and can speak for himself, hubby and I have been married for almost 8 yrs, the ex has been married and divorce already plus been thru a quite a few boyfriends (not saying anything bad just showing no stability) We have a empty bedroom, a good school here, and all his family are right here close within 10 miles of us (there is no family in Florida, Just the ex, and a brother who is younger)
School will be starting in Aug. Here its around the 9th and in Florida its about the 3rd. Is there anyway we can get a court paper of custody to be able to get him in school here, because she just is NOT going to let son move in, as hubby said "she would die and go to he!! and sell he soul to the devil before she would let son move in". She has held both kids over hubbys head since the divorce and has controlled ever move he has had with them. I believe that is 1 reason she moved to Florida. Any info would great help!!

Update; The ex did say he could come :eek: , but she said "she wont help his move including getting school records". which will probably be a big problem for us. She has custody and the school probably wont turn them over to us. I also figure she isnt going to give him his SS card or his shot records either. Its possible that when we get down there she wont let him come, I am not putting anything past her. We are suppose to go this weekend to get him. I am awaiting a call from a lawyer in hopes he can answer questions also. ANYTHING that you might know that will help.. PLEASE feel free to let me know!

No, unless you have lost all rights to recieve information about your child, you have just as much access to any records (school, med, legal,) for your son as she does. For the ss card, if she does not send it, you can go to ss and have it replaced. (I can't remember exactly how this is done, so contact ss to find out). Good luck.

Thank you sooo much mommyof4! But yet again another suprise, and it is kinda scary (provided her history) The Ex has agreed to go and withdraw him out of school Friday so we can pick him up Sat. Keep your fingers crossed for us. Maybe? she will give the SS card and shot records as well. Thanks again for the information.

If mom doesn't give the school records dad can contact the school for them. I don't remember exactly which statute number it is, but in chapter 61 of the Florida statutes it states that a NCP has the legal right to thier child's school records and medical records. I'd look it up for you, but I'm short on time today but here is the link to the Fl statutes www.flsenate.gov/STATUTES

Thank you xena, and mommyof4 I will def let ya'll know how it turns out. The school in Florida has to have a request from the school here for records. Said normally they dont give parents the records. So of course we did that, the ex is suppose to withdraw son out on Friday, but has called the Florida school and told them SHE had custody and NOT to send the records. (not sure y, I guess she thinks she will get the records). The school here called me to let me know this. Son says everything is still a go but alot he cant bring, only clothes and stuff he bought. Says his mom turning his cell off today. (no problem for him or us) We are going down tomorrow evening (5 hour drive), getting a hotel and picking him up Sat. Plus I have never got to stick my feet in the sand or ocean!!! Wish us luck for a easy go!

OK.. I wiggled my toes in the sand and of course put my feet in the ocean! The water wasnt as warm as I was hoping, but the sand felt wonderful!! And YESSSSSSS we brought him home. No trouble, with school records. No we didnt get any SS card or shot records but I wasnt going to push any issues. I figure we could manage to get a SS card and get him whatever shots from here on out he may need, the records will show he is up to date on shots. He didnt get to bring any nice clothes nor his new school shoes, but we managed to get him set for school anyway. We will get him signed into school in the morning. Thanks so much and will let ya'll know as time goes by how things go. I may need more help down the line when it comes to custody and stopping child support if he chooses to stay. For right now we are just happy that he is here and happy.
