Hi, Need to know, I work for gas station and every week if I am short any moneys for that week they deduct that amount of money from my paycheck. Now its only been anywhere from 4 to 25 dollars, but what i would like to know is it legal for them to do that? Like this week I going to have 25 and some change deducted from my paycheck do to shortages in my days ending sheets for the entire week. So I need to help and I'm hopeing someone can help me. Can Gas Station deduct from employee paycheck if there work day(s) show a shortage in money?

If you are a non-exempt under FLSA, it's my understanding that this practice is legal. Non-exempt means that you'd qualify for overtime should it be worked. However in South Carolina, the state requires written notice of the payroll deduction. This could be in the form of a company policy. If the employer has no such written policy or you have not signed an agreement allowing the deduction, then your boss should not be withholding from you pay check. This does not mean that he cannot ask for the money via other avenues (i.e. personal check, cash, money order, etc.).
