joe916 07-28-2006, 07:29 PM What is the (Is there a) time limit for EDD to determine eligablity of a claim ? Interceptor 07-30-2006, 08:38 PM I am not aware of a time limit but I have filed and heard back within 7 days on an approved claim just recently. I couldnt imagine more than thirty days. If they require more information they will set up a telephone interview. rjc 07-31-2006, 11:15 AM I do not believe there is one. In fact, I do not believe any state has a statutory time limit by which to render a determination. I am sure there are internal "policies," but nothing that is hard and fast. joe916 07-31-2006, 06:38 PM Would it be covered uner the code of civil procedures or the government code? rjc 08-01-2006, 10:09 AM Can you be more specific, ie, do you have a certain provision to which you are referring? Regardless, I still think not, but I will not say absolutely not ... yet. Megan Ross Hutchins 08-01-2006, 11:06 AM Would it be covered uner the code of civil procedures or the government code? I would suspect the Labor Code. joe916 08-01-2006, 04:45 PM rjc Can you be more specific, ie, do you have a certain provision to which you are referring? Regardless, I still think not, but I will not say absolutely not ... yet. Nothing specific, but I remember some references in the UI code. Haven't had the time to look carefully. Thought someone may have the info off the top of their head. I know their are time limits for employers to "respond". That may have been one of the references to the "code of civil procedures". I'll do more research when I have enough time to commit. Thanks all. |
