I have a question I hope someone can answer for me.My ex and I have a temp. order for visitations as we are in the midst of a custody dispute. The order states" the parties are to exchange at----- at 3:00 p.m." She does not bring her to drop her off or pick her up she has a family member do this for her.As she is to busy to do this her self. My child throws a fit every time she has to go back to her moms as she already doesnt want to go home,then to add to that problem her mother is not even there to pick her up.Do I have to send her with this person? Will i be in trouble if I dont?

Yes, you do. If the mother has designated someone to act in her place for pick up and drop off, that is perfectly legal (and sometimes preferrable). SHe may have a number of different reasons for handling exchanges this way, but you are still required to let your child go back to her mohter.

I understand your problem but yes you need to release her to her mother! In my situation when i went to court i had it wrote right in the court order that my sons dad has to pick him up and drop him off him self so i now that my child us with him and not with his family!
