Hello everyone, my husband's ex got a paper notarized saying she gives him temp. custody. I know the paper itself dont mean much, but does the judge look at it and consider it that the mom isnt stable enough to raise her child. She gave her to him and said she cant do it anymore. We are in the middle of the custody battle now, we should have another court date in the next week or 2. We have an attorney and she dont. She has no place to live, no car, no license, no job, no money. She wants her every other weekend, but she doesnt have a place to keep her and the baby. Her parents are done with her. She has stolen money and credit cards from friends and family. She asked us if she could keep some child support checks, cause we still pay. We have the baby now. Any questions, please ask.

Your husband needs to take the paper to court for the custody hearing, and yes, the Judge SHOULD take that into consideration.
Unfortunately until there is a modification of CS order your husband still has to pay the court ordered CS to Mom, has he filed for a modification of CS also, or is it just a custody petition that is pending?

Unfortunately until there is a modification of CS order your husband still has to pay the court ordered CS to Mom, has he filed for a modification of CS also, or is it just a custody petition that is pending?
Yea we know about the CS, we are not at all worried about that, we are just concerned with the baby being safe and she is. Yeah we filed for modification of custody and child support. All of it.
by the way, considerig the circumstances. Do we have to give her to the mom if she calls and wants her. I wasn't sure because there has never been a custody order placed. However I know that the mother automatically is the custodial parent but I wasnt sure since we had her can she just come and get her. I didnt think she could fight it with the cops because of our letter she wrote us. Also, her parents wanna baker act her so I really dont think she is gonna get any cops involved, also she says she has a felony warrant out for her arrest. Just curious whatcha think we should do? She doesnt live with her parents anymore, they threw her out. She is calling us from several different phone #'s and cell phones. So we are not comfortable with the baby going with her, due to her not having any place to go.

Since there aren't any court orders establishing custody I don't see where Dad would be wrong in not allowing Mom to take the child.
If Mom wants to take child Dad can try suggesting visiting in his home, that way he can keep an eye on things. If Mom is insistant on taking child, Dad can say he's going to call police. That might make Mom thinl twice, if not, Dad should call police, show the officer the paper Mom signed and the papers showing that there is a custody hearing pending. It's very possible that the police will refuse to do anything.
