Hi everybody I was Laid off by 3 weeks ago for lack of work but come to find out they replaced me by moving somebody from another department that is buddy buddy with a VP there. Is there any legal action that I can take against the company??

Barring a bonafide employment contract or CBA (union), "at will" employment allows an employer to terminate an employee for no reason at all. Since the reason they gave you for the layoff was "lack of work", you have a good chance of qualifying for unemployment.

Well I do Qualify for unemployment already and I am getting my unemployment checks BUT is it illegal to lay somebody off and say there is no work then bring somebody in your place??? How can somebody lay you off and say there is no work then they turn around and move somebody into my position??? Doesn't make sense right??? So is it worth it for me to consult a lawyer??

It's legal because you were an "at will" employee. The employer is not obligated to even give a reason for letting you go. It sounds like the reason they provided may not have been 100% truthful; but this does not constitute an illegal act. Some bosses just prefer to avoid an ackward discussion during the termination meeting.

Moving someone into your position doesnt also mean there is work. Maybe that person is covering his job AND your job.
