My company's boss likes to 10-99 everybody. I am paid salary at ~$750 a week. He says I get no paid vacation, sick days, or holidays for my first employed year. I was docked over christmas and most recently over july 4th, and am constantly reminded that I can be asked to work over 40 hours whenever he feels like it and he owes nothing to me.

Needless to say, I'm looking for another job. But in the meantime, does this all sound right? I am a computer/network administrator, so I think I'm exempt.

Sorry if this has been handled somewhere else. I'm brand new here. Thanks!

Whether you can qualify as an Independent Contractor or whether you are really an employee, is established by the IRS. While it is possible to hire someone as an IC Network Admin and treat them as you explain, it is by no means always the case. The fact that it sounds like most other employees are treated this way means that somewhere along the line, your employer is probably violating the law.

Since you are in Florida, I'd contact the Federal DOL and ask their opinion based on your job duties and the full scenario.

Wow. It would definitely seem that nobody here is a contractor, and that if I want to become a thorn in his side, he is retroactively responsible for all back taxes!

heh heh heh...
