View Full Version : Harrasment or Discrimination?? Ohio

I have worked at this company for 26 years. I have nothing negitive in my jacket. Four years ago I transferred to the shipping department. I have always volunteered for O.T. and have worked O.T. in this department pretty much non stop.
A year ago May I volunteered for a mid-night shift. It consists of me and 2 other guys. This past May I heard rumors (through day shift) that my supervisor was going to put us back on days. Now I shouldn't have had to hear this from anyone but my supervisor.
Close to the end of May he came and told us, "starting Monday your back on days".
Considering I've worked there 26 years. And he had already taken my rights to vacation when I want it. When I first transferred to shipping I was asked if I wanted to keep my hours (then days) 7 a.m. to 3 p.m and I said yes. A few months later he changed my hours 8 a.m to 4 p.m. with the constant threat of changing it 9 a.m to 5 p.m. I decided I've had enough taken from me for all my years in that place. I went to the next guy in charge..and said "Hey" and I've been able to keep my mid-night shift.
But now..I'm being punished for standing up for myself. Along with other things, The people who've been there 4 years are getting over-time. I'm not.
When I showed an interest in getting overtime. He posted "Mandatory 10 hours DAY SHIFT ONLY"..
I've really been there to long to be treated like this. Our Human Resource guy is a waste. What else can I do or should I do besides running to the plant supervisor all the time??
I have seen my supervisor "punish" others for crossing him..I feel it's childish and unprofessional.

You haven't provided any information to suggest that the harassment or treatment you are suffering is based on any factor protected under the anti-discrimination laws. Therefore, your only recourse is to report the supervisor's behavior to higher management. Maybe, if they receive enough complaints about him they will do something to rein in his behavior. Unfortunately, it's not illegal to be childish, spiteful, or unprofessional.

Are you the only person working the night shift? If not, your effort will probably be more successful if all those working the night shift who are restricted from working overtime complain to management.

Let me add a second opinion, since I agree with what mom said, but I'll amplify a couple of different aspects.

There is nothing in the law that says a supervisor must always treat ees fairly, nicely, with respect, or to recognize their senority and past contribututions to the company. These are all human values that you and I may agree represent best practices in how to treat people, but the law does not require the supervisor must agree. Your supervisor can be a flaming a**hole as long as he is an equal opportunity a**hole and does not dis out his a**holiness based on protected characteristics such as race, sex, religion, etc.

If I were in your shoes, I'd feel unfairly treated too. But unless you have some solid reason for beleiving you are being singled out for disparate treament because of your race, sex, etc., or you have some written contract or union collective bargaining agreement that formally recognizes your senority rights here, nothing you've described sounds like illegal harassment or discrimination. Supervisors have the right to make decisions as to who works and when...that's why they are called supervisors.
