I have a friend that is being sued by the company she quite from a couple of years ago. They are stating that she submitted paperwork that gave them a higher match rate than what the company pollicy allowed. She hired 3 people this way and they now want her to pay them for this and not the employees. Any help would be appreciated. She did not profit from this in anyway.

Was she the administrator of the plan, i.e., did she have fiduciary responsibility?
