I was wondering if I could get some legal advice? Today I was fired from my job as a Certified Nursing Assistant. I have been employed with this company since April 2005. I have never been wrote up and asked to sign anything. Recently we had some students come in to our facility to train with us and one of the students made a complaint about me to her teacher, who is also to become the new director at the end of the month. This is the first
incident I ever had of any kind of my interactions with my residents. I was talked to about this incident and was told that I was not on probation nor was I terminated. I did not have to sign any written notice about this. This past weekend this same teacher was at the facility with her students. One of my residents had fallen and I wanted a second opinion on whether she may be hurt or not, so I had a student go get the teacher. She did not like the fact that I had her called when she was in the next room, instead of me calling someone from the other end of the building. Naturally she was closer so I got her to come. Well on Tuesday she was back at the facility with her students. I was off this day. I came in Wednesday and was filled in on a meeting that took place on Tuesday. The teacher approached my boss and told him that I didn't know how to do my job. He didn't have a chance to talk
to me on Wednesday. But he called me in the office this morning and told me that he was letting me go. He never would say a specific reason on why. All he said was I "just wasn't cut out for the job". Said they couldn't have people
working there that just considered this "a job".
My main question is, do I have a case of wrongful termination or discrimination here? I was fired from my job for what I feel is no reason. There is another employee that has abused residents on several occasions. She had three incidents within one week and was only wrote up on one of those. No threat of termination. Can they fire me for no reason and not fire someone else for something as serious as abuse?
I'm a single mother and at a loss of what to do. I was told by someone, who
works with Human Resources at another company, that I should contact someone about this. And to get in touch with EEOC. Could you shed some light on my rights please?
