Father is being served for child support after 13 years. Everything seemed to be ok but now the mother is going after him. He is remarried and has 2 other kids with his wife and a stepson. Will the courts look at wife's income and other children when calculating child support or just his income? If they only look at his income do they take into consideration his other 2 kids?

the courts will look at the wife's income but it doesn't play apart in how much he will pay. at least thats what they will tell you. but now that he has 2 kids with someone else the courts will look at that. as for a step son you will have to say that he receives direct support from the husband. but when it comes to the new income it does play apart in how much he will pay. the lawyers ive talked to say to keep everything seperate. but by doing that it still doesnt help out to much. cause i did it and the judge looked at it and said too bad.

new wife's income doesn't count. not her job to support his kid. new kids MAY be considered depending on whether there was already an order for CS and state statute, but in most places, younger children are not taken into consideration
