I work for a title office and have worked overtime through out the year.
I was told verbally that I was not to charge overtime even though I have to work overtime.
I was told [verbally again] that I could get my time back in what is called in the company [comp time] that is taking time off and getting paid straight time instead of time and a half.
I am sure that it is illegal in Michigan to bank hours and not get paid time and a half, or am I wrong?
I have documentation of being paid overtime up to a certain point and from that point on only 40 hours.
I go south for the winter for 3 months and was comped my overtime while I was gone, but only half of it.
The company I work for said that they would not pay me up to date.
I am always behind two to three weeks.
I am now being denied taking a week off in august to gain back some of m overtime.
Do I have a case to go to the Michigan labor board with a complaint and if so could some one walk me through the process?

If you are a non-exempt employee and work more than 40 hours during the workweek (not pay period), then you must be paid overtime for the additional hours.

The state of Michigan does allow comp time under certain conditions. I'd suggest reading through the 'Comp Time' Guide via the link below to see if you fall into this category or not. If you aren't covered by the provisions list there within, then the first statement I made would apply (provided you are a non-exempt employee).
