I have a question on if I will be able to get unemployment. I have been with my current employer for almost three months and then one day I was called in and informed that I am on some kind of registry in kansas for neglect and abuse on a child. I was informed that I could either resign or that they would allow me some time to research this, which I did go ahead and research it. SRS could not and wouldn't provide me with any information and told me that they are in the process of trying to find the paper work on it. Its been 3 weeks and they have not found anything. I did get an attorney and he is in the process of trying to help me get this fixed. I told my employer and at first they told me that they were going to go ahead and transfer me to another area that I could work but then they called me the day before I was to report to work and told me not to yet and that they would contact me again soon. About two days later they went ahead and sent me a termination letter through the mail telling me that becaue of this they can not keep me on any longer and that they had given me till a certain time to get this fixed.
So now I'm without income. I remember that when I was first hired on that I filed out the appropriate paper work and signed a paper that made it clear that my employment there is pending getting all of my background information back. So since this happened but yet I didn't know about it and strangly enough I was employed there for almost three months will I get unemployment? According to the some of the statues I have read this background info was suppose to have come back with 5 to 10 days before an employee starts.

Since the LLT crystal ball is out for recalibration, no one can say if you WILL get unemployment except the state. You can certainly apply; there's no charge and no penalty for being wrong.

What is SRS? Have you been convicted of or plead guilty to a charge that would put you on such a list? What kind of work did you perform for this employer?

SRS is the state with its social workers that investigates crimes against adults and children. They also assist in food stamps and other things.

I have never been convicted of a crime or even arrested which makes me angrey because I feel that this list that they have is a scarlet letter and that it is unfair and unjust and that I have been denied my right to due process. The people with the state that I have talked to so far about this feel that they have the right to do it and that it is appropriate. I found out that this list is used to keep people from working with adults that have disabilities and children. Anyone can be put on this list without being charged and in my case without even knowing what the charge is.
