I am trying to find out how to get parental rights terminated on my soon to be ex husband..a month a go i filed for divorce and my husband has untill the 21st of this month to respond to make a long story short 9 months ago he went to jail for domestic violence child wittness and got off with 3yrs probation, he is to have no contact with me for 3yrs there is also a restraning order that states he cannot see his daughter and it is up in october the divorce states there is no parenting time for him due to the restraining order and since he cant have any contact with me therefore he can't call to ask about his daughter how will that affect the situation? he still calls me i guess he thinks since he is in florida and i am in oregon they won't do anything last month he was pulled over got 2 DUII 10 days apart the last one he got he got out of jail and took off to live with his aunt in florida he did not notify he probation officer he as of last week is still paying child support.he has a drug and alcohol issue and is not attending classes is there some way of me terminating his rights without having to get him involved please help....

First, there's no way to terminate his rights WITHOUT him being involved. You can certainly file a petition to terminate but he has to be notified and given the opportunity to be heard in court. Talk to the lawyer who's handling your divorce (if you have one) about the possibility.
Most state's require a step-parent be available to adopt before a legal parent's rights are terminated, however, since you aren't divorced yet this isn't an option.
Second, do you know that if a court does terminate rights that the responsibility to pay CS will also end? That's something for you to consider as well.
