I have had a horrible experience with a custody battle. My husband (my children's step father) was arrested for dealing in narcotics. My ex husband immediately filed for emergency physical custody even though he has had hardly anything to do with the children for the past 7 years. I was not involved with the drugs and tested negative for everything the same day he was arrested. The arresting officer also testified in court that I was not involved at all. The judge still gave custody to my ex and I lost my kids. The grounds were all due to the step father being arrested and nothing whatsoever to do with me. My children are 15 and 11 and want desperatley to move back to the only home they have known their whole lives. I am not and have never been in any legal trouble and have never put my children in harms way. How could this happen?

How long ago was custody changed? If it was with-in the last month you need to get a consult with an attorney who handles appeals to see if your case is appealable.

I DONT WANT TO ATTACK YOU BUT IF YOUR MARRIED TO THIS MAN AND HES IN YOUR HOME WITH YOUR KIDS AND HE'S DEALING HOW DO YOU NOT KNOW THIS??? AND THAT ALONE IS SOMETHING THAT YOUR EX HUSBAND CAN HAVE CUSTODY FOR. IT JUST LIKE CHILD INDANGERMENT. shipwreck brought up an excellant point, are you still with your husband? If you are it will probably be almost impossible to get your kids back as long as you are living with, and married to your husband.

No matter how much you love your hubby, you will probably have to make a choice- him or your kids. Good luck.
