View Full Version : Overtime - Meal Period worked Texas

I work in a one person office (wrecker dispatcher). The shift is 12am to 8:30 am, with the next shift scheduled at 8:00am to 4:30pm. The 30 minute overlap is reserved for the meal period placement, in otherwords we are required ot eat at our desk but are relieved from duty and have the quiet time at the end of the sfift. My problem stems form a consistently late relief person. My question is: suppose they do not arrive until 8:45, do I leave and expect 15 min OT pay or stay 30 additional minutes (quiet time) and then expect 45 minutes OT pay. Before it is stated, the employer does not disciline the relief employee, or the previous 4 employees.

The answer to your question is determined by company policy, not law. How does your employer want you to handle it?

My employer doesn't pay me either way. I'm getting screwed out of something, just trying to figure out what, how much. They are completely oblivious to the tardiness problem let alone pay for additional time.

Well, there's nothing you can do about the employer not disciplining other employees for not relieving you on time, if they choose not to.

However, if you are working over 40 hours in a workweek, you're eligible for overtime pay and can file a claim with the Texas Workforce Commission.
