I work in a shipyard in WI where our established work week is from
Sun thru Sat. The company is currently forcing us to work weekends.

It is my understanding that under WI law I am entitled to one day off during every calander week since our work week and calender week are one in the same.

This scenerio applies whether I have worked twelve days in a row or not.

Am I correct in my line of thinking because there seems to be some confusion among my coworkers as to how this works.


Thank you for any advise you can give to clarify this matter

This should answer your question. BTW, a "calendar week" does not necessarily have to correspond to the company's defined "work week".

Am I correct in the belief that I am entitled to one day off in any given work week? That is, if I work Sunday thru Friday, I can not be forced to work Saturday.In essence, they can only force me to work six days of any establishd work week.

The company has most of it's employees believing that they can work them twelve days in a row,give them one day off, then work them twelve again and so on.

What I am searching for is some plain writen literature that explains the 'one in seven law ' so there is no misunderstanding to it's meaning.
I could use some help here.

No, that's not what it says. It says "calendar week". That is every seven days. If the law meant "work week", it would have said "work week". As I stated in the response, the calendar week does not have to correspond to the work week. As the information in the link specifically mentioned, it could be 12 days in a row. The "day off" in the first calendar week could be day one of that week. The "day off" in the second calendar week could be day seven of that week. Hence, 12 days worked straight, which is legal. Did you access the link and read the information there?

It's one day off in ANY consecutive 7-day period. The link seems pretty clear to me. I'm not sure how else to explain it.

So basically what it states is that if I work the Sunday at the beginning of the week,then work my regular Monday thru Friday, they cannot force me to work the following Saturday.Correct?

No, that's not what it says. It's ANY calendar week, starting on any DAY of the week. The calendar week does NOT have to start on Sunday. Why don't you just call the state Dept. of Labor and have them explain it to you.

I was under the impression that a calender week was from Sunday thru Saturday.

Obviously my thinking was incorrect.

A calendar week can be Tuesday through Monday, or Friday through Thursday. ANY consecutive seven days can be a calendar week. There is no law, legal or temporal, that limits a calendar week to Sunday through Saturday.
