Could I get an annulment?
My ex filed for divorce in 2000 after 8 years of marriage and the divorce was concluded in Feb 2002. He had no assets at the time of the marriage and aquired no assets during the marriage. I had assets before the marriage and acquired more during the marriage.
We have 3 children, though I suspect he is gay or asexual because he avoided intimacy except when he wanted a child. (8 times total in 8 years of marriage and none at all after our 3rd child was conceived)
He has a history of psychiatric treatment as a child and during his twenties, though I was unaware of this history until after we had been married several years. During a child custody home study done at the time of the divorce the psychiatrist chosen by the court to do the home study wrote that in his opinion the ex has a schizoid-type personality disorder.
I believe that my ex got married only because he wanted (1) to have children and (2) to have access to my assets. In the end, he walked away with just under 1/2 million dollars (1/2 of the "marital" assets thanks to Kansas divorce law) and joint custody of the kids.
He continues to harass me by constantly filing motions in court to modify child support, custody, visitation, the kids' schooling, etc.
What recourse do I have other than to keep going to court evey time he decides to file a motion? He rarely wins but continues to file.
I have recently seen information about annulments. Do I have grounds to petition the court for an annulment because of fraud or psychiatric history? Would an annulment allow me to go back and recover some of the assets? Would an annulment allow me to get the joint custody arrangement changed?
Are there any other options for changing the custody arrangements that would limit his ability to continue to harass me by filing motion after motion? Kansas courts seem to favor the joint custody arrangement where parents co-parent including mediation if necessary. I might add that we have been to mediation and the result is always the same, either I agree to what he wants or he files a motion and we head to court again!
