View Full Version : Help - not sure if I was Fired California

OK...here's the story...

I work for a company that resides in an office with another company (owners are co-mixed between the 2). Yesterday, I called the main phone line and asked the employee of the other company to let my employers know I couldn't be in. (This is how it's been done EVERY time). The employee did this.

This morning I got to work and they had deactivated my entry key. I called the back line and an employee came out and let me in. I then received a call from a different employee of the other company, who informed me that my employers would be out the rest of the week and I was supposed to take the rest of the week off and come in next week. When I asked him if I was being let go he said "I don't work for your company & I don't want to get involved."

I called my employer's cell phone and inquired what was going on? He and I then went around & around regarding several issues he said we would talk about it at my exit interview next week. I said I was not coming back if I was being fired today. He said I abandoned my job because I left early one day & didn't show up the next. (not true-I worked an extra 15 minutes & then called in the next day as I have on every other occasion.)

Long story short he hung up on me, then called right back and informed the employees of the other company that I had been fired & to make sure I left the office.

1. Was I fired or did I abandon?
2. What about my final paycheck? (also, The one for the pay period before this one bounced, have to wait & see if the replacement of that one is good?)
3. Do I have to be paid for today, since I showed up?
4. If they fired me, was it today or next week?

1) I would argue you were fired. When you file for unemployment, explain the situation and let them decide.
2) You should have received it. File a claim with the DLSE
3) Yes, for half your scheduled shift, or 4 hours, whichever is less
4) today
