View Full Version : SENT HOME BY H/R-SICK-NO PAY-8 HRS-BEFORE/AFTER HOLIDAY-DR. NOTE-ETHICS California

The company I work for requires employees to work a full 8 hour day the day before a holiday and the day after. This is not an uncommon company policy however; in my case I went to work, very sick on the day before a holiday and completed 5 hours of an 8 hour day. I checked out for lunch and took some paperwork to H/R. The H/R representative took notice to my illness and required I leave work immediately and return with a doctor's release to return. Under normal circumstances due to the stage of illness I would have called in sick however; I decided to do the "right thing" not only for the paid holiday but also for the shortage in staff. I understand and agree with being sent home in order to reduce any further employees getting sick but it was Human Resources who made me leave prior to completing an 8 hour day. I was advised by H/R that I will not be paid for the holiday due to not working an 8 hour day after they required I leave the office! I realize it's only 8hrs without pay but is this right? It was not as if I called in sick, rather the company made the decision that I leave work. Is there any recourse I can take? Are they really that hard up for income that they take this stance?

As a non-exempt employee, you have no legal expectation of being paid any time you do not work. It may not be fair, but it is legal, to have that time be unpaid.
