View Full Version : How long do I have to file a discrimination lawsuit in the state of Florida? Florida

I feel that I was discriminated against by my manager when I was pregnant. I went to HR to express my concerns, but the HR manager only defended my manager with replies like "well, that was inappropriate, but I'm sure he didn't mean it that way."
I felt that it was such a hostile work environment (it actually gave me high blood pressure and caused my dr. to put me on bed rest for a week!), that I resigned rather than returning from maternity leave. Before I went on maternity leave, I tried to find another job internal to the company so that I wouldn't lose my tenure, but my boss denied my post, citing an undocumented "rule." He then told me that he would keep me for 90 days (another undocumented and inconsistent "rule") even after the above "rule" no longer applied, thus hindering my future chances of posting out of the department.
So I took a job with another company, and it pays considerably less than what I was making. I've also lost all my tenure and its extra sick and vacation time.
What's the time limit on filing a discrimination suit? I'm still a little hesitant, because my husband still works for that company, and I don't want to cause him to lose his job, but I hate the thought of this jerk getting away with it!

I work in California, but the main office is in Florida. The handbook states holiday pay for full time hourly employes (which I am). However, I never get paid for them. Is this legal?

No state law requires paid holidays for employees of private employers. Have you asked HR why you aren't getting paid holidays per the employee handbook? This is a company decision, not a legal one.

Florida is a deferral state. You have 300 days from the date of the alleged discriminatory act to file a complaint with either EEOC or Florida's human rights agency. You can't file a lawsuit until you receive a notice of right to sue from one of the agencies.
