I am one of 10 camp & year round property owners in Maine who have used an access/right of way to a pond for 30 or more years, some as long as 50 years. We were just informed that new owners of the land abutting the right of way have acquired the land that the access is on, a 50 foot right of way, and we are being told that we will not be able to use the land to launch our boats or to swim after this summer. This is not a public boat launch, but has been used by the campers who do not have waterfront property.
Do we have a case for prescriptive use of this right of way, since we all believed (and it show up on town maps as a 50 foot right of way and is mentioned in some of the deeds as a boundary) that it was our access to the pond and have been using it without interruption for decades?
