The filing fee cannot be waived and is due upon filing; however if you do not have the full amount at the time of filing you may pay the fee in installments. An application to pay in installments along with the initial installment must be filed at the time of filing your petition in bankruptcy. Applications must propose a plan for payment in accordance with the schedule approved by the court. The schedule for installment fee payments is:
For chapter 7 cases an initial payment of $75.00 is due at filing. One month after filing the second installment of $75.00 is due and the final payment is due two months after filing in the sum of $50.00. Each payment is due on the same day of the month as the date on which the petition was filed unless that date falls on a day that the bankruptcy court is closed; payment is then due no later than the next business day.
For chapter 13 cases an initial payment of $70.00 is due at filing. One month after filing the second installment of $70.00 is due and the final payment is due two months after filing in the sum of $45.00. Each payment is due on the same day of the month as the date on which the petition was filed unless that date falls on a day that the bankruptcy court is closed; payment is then due no later than the next business day.
For chapter 11 cases an initial payment of $430.00 is due at filing. One month after filing on the same day of the month as the date on which the petition was filed the final payment of $400.00 is due unless that date falls on a day that the bankruptcy court is closed; payment is then due no later than the next business day.
For chapter 12 cases an initial payment of $105.00 is due at filing. One month after filing the second installment of $75.00 is due and the final payment is due two months after filing in the sum of $50.00. Each payment is due on the same day of the month as the date on which the petition was filed unless that date falls on a day that the bankruptcy court is closed; payment is then due no later than the next business day.
