My boyfriend has been working for USF and All Childrens Hospital for about 7 months now. They say that he is still temporary and they wont put him as a permanent employee. He has done nothing wrong, and they tell him they can't trust him. When it's someone elses job to do something and it doesn't get done, his boss will go yell at him instead of the person who was supposed to do it. His boss brought him into her office a few days ago and told him he was worthless and hes lucky he hasn't got fired yet. Is this discrimination because hes 19 and everyone else is 30+? And secondly can they keep him temporary for this long even though they said he would be permanent before he took this job?

No. (a) There's no evidence that he's being singled out because of his age, and (b) even if that's the case the laws that prohibit discrimination on the basis of age only apply to those 40+ years of age. If they want to treat him lousy because he's 19, they can.

Sounds like your boyfriend needs to start looking for a new job. Things just aren't going well where he is.

No it is not illegal but it might be unfair. As I have yet to not be the youngest in my department anywhere I've worked, I can relate on some level but the law only protects age discrimination for those over 40. It is not illegal to have him still bea temp, particularly if they are unhappy with the work he does. Whether this is a fair assessment or not isn't the issue. They are not obligated to bring anyone on FT, absent a contract to the contrary. The only stipulation is that they may not keep him as a temp to avoid paying benefits, though he would be hard pressed to make this claim in light of the performance issues and the fact that he has only been there 7 months. Successful court cases in this area have typically been with those who were kept on temp status for years.

It sounds like the handwriting is on the wall here and he needs to dust off the resume and start applying elsewhere.
