View Full Version : Unpaid sales commissions -Florida

I am/was a sales person for a company whose headquarted in Atlanta and I worked for their branch office in South Florida for 2 years. I am/was on a salary + commission pay structure. I made sales in April and May, that need to be installed. I resigned from the company prior to these installations being performed. My compensation package (which is signed by me to acknowledge stipulations) states that commissions are not to be paid until the equipment is installed and the customer signs an acceptance form. I handle only the sales part of the transaction. I get the orders signed, get the deposit check (these are leases) and get the leasing documents signed. I have no involvement in the installation of the equipment. My commissions are/were in excess of 8,000.00. Since I fulfilled my duties pertaining to the sales, do I have a legal right to be paid the commissions. Please advise.

You will have to have your agreement reviewed by a local attorney versed in contract law. We cannot interpret a document we have not read in its entirety and we don't know anything but the few details about the agreement and the business practices than you've shared.

This is not a wage and hour issue in Florida (nor the majority of other states). It MAY be a breach of contract issue, but only an attorney who has read the agreement and knows all the details can properly advise you.
