My Wife Is Asst Mgr At A Retail Store And They Have A Written Policy That There Must Be At Least 2 Employees In The Store At All Times, But They Are Required To Take A 30 Minute Lunch Break Off The Clock. When My Wife Did This, She Went To Mcdonald's And Ate. When Asked Why She Left The Store She Told The Mgr. " If I Have To Clock Out, Then That's My Time, Not Yours And I Should Not Have To Stay Here And Provide Change Or Whatever For The Cashiers". She Was Threaten With A Write Up And Termination. Is This Legal?

To begin with, please do not capitalize each word. It makes your post very hard to read.

SC law does not require that the employer provide breaks at all, and I can find nothing to say that he cannot require your wife to remain on the premises. As long as she is entirely relieved of duty, she does not have to be paid.

So yes, it was legal to write her up and yes, it would be legal to terminate her for leaving the store. PS - if she DID have to come back on duty and serve a customer or make change, she would have to be paid for the time. But it would still be legal to write her up or term her for refusing.

I Work In A big Hospital In Nutritional Services and I Wanted to Know If you work a 8 Hour shift How many hours do you have to work to get a luchbreak
