I am (was) a hazmat driver in Ky., paid every two weeks. My employer never fails to cut my check for actual hours worked, and has been doing so off and on since I have worked there for 3 & 1/2 years. I quit almost two weeks ago. What are my options now? And I don't mean as far as finding another job!!!! Can he do this and get by with it?

What is it your employer is doing? If they are cutting you the check for hours worked, I'm not sure what you are seeking.

Your boss is cutting the amount of hours you worked so your not getting paid for all of your hours? Do you have proof of the hours worked like a timecard? Start making a chart of hours worked for you records! If your boss is not paying you for all of your hours,I think you would call your states Department Of Labor. Elle can give you more information. How many hours is he cutting from your checks and for how long again?

If the employer is shorting you hours, is he paying the hours on the next check? If not, contact the state Dept. of Labor and file a claim for unpaid wages. The employer will have to prove you didn't work what you claim.

Yes my boss is cutting my check for hours I have actually worked. In other words, I work long hours, but don't get paid for all of them. I always let him know that my check is short (last week $135, two weeks ago $176). He always pretends that it will be added to the next weeks pay, But it is never there, AND that check is usually off by a few actual hours as well. I've looked around my states website, but I've been unable to find any information that pertains to this particular dilemma. This has been happening off and on as long as I've been there for 3 & 1/2 years. I've confronted him several times, I get lots of promises, but not my money. He sometimes gets it right, but then the unpaid wages from "whenever" are not on my check. I honestly believe he thinks I'll forget about it, then another check or two down the road will be short for the hours I have actually worked. And yes, I do keep my own hours written down when I clock in and out. Any suggestions from here? :mad:

Contact the Department Of Labor immediately!! He owes you alot of money!!!! Good luck to you! Guess he figured wrong when he figured you would just let it slide,but you did let him get away with it for a long time! Glad you have records,though as stated above,your employer has to prove you WERE NOT there,which he can't because you were! Good luck to you!!

It is inherent in the federal Fair Labor Standards Act, to which all states must adhere, that you are paid for all hours you work. Please excuse our confusion in the use of your word "cut", because in payroll language, to "cut a check" means to issue a check.
