We clock in every shift on a time clock. If we clock in 1 minute late it is noted in our personnel file and reflects on our "dependability" score on our yearly evaluation . Although I suspect this is not illegal it is demoralizing and petty. should I try to speak to the "Time Clock Guru's" boss or just let it go?

Let it go. It may be petty, but it is not even remotely illegal. The law does not require them to give you any kind of grace period. One minute late is still late.

I agree that it is not illegal. Morale here is a problem - we have a 47% attrition rate!! I am in a position - 3rd from the top - to have a dialogue with the director and let her know that I think it is a crummy way to do business. The asst director is the one doing this - he is a tyrant. The director is often left in the dark as far as his antics are concerned. I'm just trying to get feedback - thanks for your opinion.

Now, what you just added makes a difference. It helps to have all the information. I thought you were a disgruntled employee who might get himself in trouble trying to argue with the boss.

If you are in a position to change the policy, or at least to have an effect on it, that changes my answer. In that case, I don't see that it could do any harm to try to implement at least a 5 minute grace period.

I have a similar problem. We are considered late if we clock in one minute over, but this goes further. If we are late 3 or more times in two pay periods (which is a month), then we lose one 8 hr day of PTO. I was told that witholding the PTO we have already earned is illegal. Is this true?

Nope. It's not. Not unless your state considers PTO to be wages, and I don't think it does. Better start getting there on time.

Nope, Kansas does not require a use-it-or-lose-it policy. The policy of reducing PTO as a disciplinary action, therefore, is not a violation of any law in your state.
