View Full Version : Temp agency worker do I get overtime? Alabama

Hello,

I recently started working for workforce employment agency. I was sent to work for CVS a part of the hyundai corporation. I am an hourly worker (clock in clock out) Anyway I am required to work 10 hours a day 6 days a week. we get paid a flat rate of $8.00 an hour. I was told that some weeks I will be required to work 7 days a week but that has not come up yet.

I have talked to several people who work for workforce at CVS nobody gets overtime. I asked why and nobody even considered the possibility. They say that they just don't get it. (Most of the workers (99%) are young and African American)

Also if Hyundai decides to pick you up as a permanent employee after 190 days, nothing changes, except you are elgible for benefits. You do not get a raise and still do not get overtime pay. Some of these people have been working there for a year or more.

My question is, are we exempt for some reason or is Hyundai/workforce taking advantage of an uninformed workforce?

Who actually issues your paychecks? Are you working under some type of training program?

I would say that first you need to know when your pay periods begin and end. I have found that tends to be the biggest misconception about overtime, and when hours actually become overtime.

What is the 7 day period that constitutes the work week.

That said, yes you should be getting paid overtime for any hours worked over 40 in a work week, even if you work for the agency.

Work Force issues our checks.

I guess Our work period is Thursday to Thursday since we get paid every Thursday.

You should really find out how the pay period runs.

It could be Sun-Sat and you may still get paid on a Thur.

Ask the payroll person at the agency. (Work Force)

Not necessarily. Where I work, the work week is Sunday at 12:01 a.m. through Saturday midnight, and non-exempts get paid on Thursday. There has to be a certain amount of time to figure hours and overtime, cut checks, stuff them in envelopes, etc.
