With my previous employer, I was a retail store manager that was required to work 43 hours a week. All hours worked over 40 were paid at a half-time rate...This doesn't sound legal to me and on my pay stub, there was an hourly rate, not a salary amount. Do I have any recourse?

Unless your scheduled hours regularly fluctuated above and below 40 hours per week, the fluctuating workweek method that provides for overtime at half-time only is not allowed. You can file a claim with your state Dept. of Labor.

Thank you! The work week hours never fluctuated as we were required to work 43 hours or more a week. I will definitely contact my DOL & take action,not only for myself but for everyone else who has been taken advantage of with this company as well.
